I formatted the system just to check and tomodachi life disappeared.
Serials are identical, first thing I checked.

it's true it will disappear, doing a system format on a console with a pre-installed game.
BUT
As soon as you make a nnid or login with your nnid you can redownload the game for free, since the Game is tied to your consoles serial, not your NNID

IF the system you openend, had tomadochi on it and you had to do the whole setup stuff,
- It came out with 9.9? (doubt it) i bet somebdoy updated the system then did the next thing
- Somebody was smart enough to system format without SD in the system, then placed SD back, since the game is on SD and tied to your consoles serial, not the NNID

IF the system you openend, had tomadochi on it and you didn't had to do the whole setup procedure, then it was used and updated

Wonder if it's safe to buy one of those bundles since I assumed they would be on 9.2 directly since it's the update that comes with Tomodachi Life in Europe...i find the colour a little too Ogirly for my tastes though...

Hmmz, indeed it makes a new folder on the SD.
Anyway, wierd case, everyone i know with a 2DS just bought has a lower then 9.2 sysnand

Refurbished is the only reason I can think, but does nintendo sell refurbished without labeling It as refurbished??

They shouldn't really. Unless they have that see-through wrapping with the Nintendo watermarks on it.

Hmmz indeed a possibility, system was returned for repair or traded and refurbished, that's a possibility

Yeah, my 2DS was second-hand though, but I just know this from experience (from buying the launch 3DS and also the N3DS as well.)

Interesting... amazon.co.uk have been selling the 2ds/Tomodachi bundle for £75 during their black friday/cyber monday fortnight of sales (although the o3ds xl with Mario Golf and Mario & Luigi Dream Team for £99 is a better deal)- if I hadn't just bought a new 4k tv in the sales I may have bought one myself. I'd presume it would be on <9.2 too.

this is impossible, format system will generate new unique id and setup new folder under Nintendo 3DS dir

my North-American N3DS and all the others in the store didn't even have the round transparent stickers anymore that the O3DS XL had on its box. From the little cardboard flap it was likely never opened, but there was no seal.

Nintendo is updating 2DS's. Nobody is safe now.

If it can be of any help, I bought last week from Amazon Spain a transparent blue 2ds (the basic one, no game bundled, sold & shipped by Amazon) for €80.
Although box was not with its plastic wrap, system version was 7.2 :-)

I bought a 2ds 2 weeks ago , Mario kart bundle it was 8.1
