Every single time someone tries releasing a homebrew that looks cool and uses copyrighted characters or concepts, it gets a Cease and Desist letter and then never sees the light of day, no matter how far into development it was at the time.
This is annoying.
It doesn't have to be this way, however. There's two ways to avoid it: Either don't tell anyone you're developing it until it's finally done and released, that way by the time Nintendo's lawyers tell you to stop, copies are already all over the internet and they'll never be able to track them all down and get rid of them.
The other way is to release your source code and assets with each update. That way, the code will end up distributed throughout the net and Nintendo wont be able to get rid of that, either. Other people will then be able to finish your homebrew, and when it's finally released, nobody will be able to prove it was you that did it.
Please, for the sake of the homebrew community, start doing either of these things. It's getting pretty tiring seeing awesome projects being lost in the mists of time and copyright violation because, for some reason, the developers seemingly have never noticed the same thing happening to millions of other homebrew projects in the past.

That was back then, this is now, I doubt they will, and even if they do, they can't stop anyone from doing it as long as they don't take credit in any way for everything and give full credit. They won't make one, they've already stated that SSBB is the last Smash Bros. to be made as it's meant to be a trilogy.

They shut down the first Smash bros port on the DS back in 05 (or was it 06?). Nintendo does care, they just might not follow the homebrew scene very closely.
