Every single time someone tries releasing a homebrew that looks cool and uses copyrighted characters or concepts, it gets a Cease and Desist letter and then never sees the light of day, no matter how far into development it was at the time.

This is annoying.

It doesn't have to be this way, however. There's two ways to avoid it: Either don't tell anyone you're developing it until it's finally done and released, that way by the time Nintendo's lawyers tell you to stop, copies are already all over the internet and they'll never be able to track them all down and get rid of them.

The other way is to release your source code and assets with each update. That way, the code will end up distributed throughout the net and Nintendo wont be able to get rid of that, either. Other people will then be able to finish your homebrew, and when it's finally released, nobody will be able to prove it was you that did it.

Please, for the sake of the homebrew community, start doing either of these things. It's getting pretty tiring seeing awesome projects being lost in the mists of time and copyright violation because, for some reason, the developers seemingly have never noticed the same thing happening to millions of other homebrew projects in the past.

Well SmashGP has been around for a couple years and they use all sorts of copyrighted characters and stages, including all the famous Nintendo characters. They haven't got a C&D from Ninty yet

Hmm, I doubt they'd get a C&D either way, mostly because well... Nintendo won't really bother. Also, as long as they don't charge or anything there is no problem. It's basically like a mock-up game.

The game is quite good so far. Can't wait for more out. I remember seeing something else being made as well that'll be like MUGEN, with those 2 games, the fighting games for the DS will simply be amazing. :|
 
Hey, Nintendo will definitely issue a C&D order on this. Why? So they can make their own SSB:DS and release it in 5 years to keep the DS going strong.

They shut down the first Smash bros port on the DS back in 05 (or was it 06?). Nintendo does care, they just might not follow the homebrew scene very closely.

I say when the C&D letter comes - rename the game and make new characters and stuff.

They won't make one, they've already stated that SSBB is the last Smash Bros. to be made as it's meant to be a trilogy.

That was back then, this is now, I doubt they will, and even if they do, they can't stop anyone from doing it as long as they don't take credit in any way for everything and give full credit. It's hard to explain IP, but in essence I can use IP for anything non-profit, no matter who's it is.

Also a PORT is not homebrew, there is a VERY large difference, so if it was a port yes they shut it down for a reason, this isn't a port, this is homebrew. Another thing worth mentioning is that as long as it's opensource (Not sure if this dude bothered, I hope so though) they can't do anything at all.
 
Strange enough they got rid of freeloaders with 3.3 and don't seem to give a damn about their copyrighted characters. Smash Bros characters are still Nintendo. I wish that the game was a little more complete, I used no$gba and its ok, I couldn't my GnM.
 
This game is kick ass in more ways than one. I can't wait to see the end result and will be following this project closely. Fortunately the creator is starting to make his entries in English as well
