Hacking Sony suing eBay seller

Not sure whether this is the right section to post, Sony are suing a seller on eBay after selling a modded console with games.

IMO he shouldn’t have been so brazen about it, you’re asking for trouble advertising like that.

Yeah, pretty much asking for trouble to list anything on ebay like that... could've quite easily made it sound like a genuine console with "included games", while still hinting at the jailbreak, and gotten away with it.

Indeed, if he hadn't openly advocated piracy and advertised the consoles for that purpose he probably would have been fine.
However, I'm still not sure it's legal for them to take his PS4s. He owns the hardware, he's allowed to hack them. I don't think there's anything in the DMCA disallowing modifying devices you own. It only becomes illegal once you pirate or facilitate piracy. Which still doesn't justify them taking his PS4s.

There’s definitely means and ways of advertising the consoles. I’ve read from another source that Sony actually purchased two of these consoles from eBay, and they included instructiosn on how to “add more games”.

The issue here is piracy, not homebrew enabling or the fact it was a 5.05 console.

I hate Sony but I am glad that Sony sue the seller. We jailbroken our PS4 but we shouldn't sell it with the games for the profit. The seller is stupid and an idiot!

Yeah - this is the thing I always have an issue with on ebay. Whether it's someone selling a usb stick for your Wii, an sd card 'pre-configured' for your flashcard/everdrive, or a fully loaded retro-pi - selling roms/isos/etc is scummy as fuck (as is "selling" emulators)... including them for 'free' with some second hand hardware - I can just about accept that.

I once was selling a 3DS and my post was immediately deleted when I mentioned it was hackable.

Smart buyers and sellers can understand each others. It just can be hinted that PS4 firmware is 5.05 or below.

Well eBay doesn't allow jailbroken consoles anyway. The things people do for money. I remember people selling usb sticks with kmeaw CFW for the ps3. Fucking disgusting

PS4 doesn't have permanent jailbreak, so it's just a case of listing PS4 5.05

Maybe nintendo or sony will go after those assholes that sell the raspberry pi with like 30k games. But yeah you never sell anything hacked loaded with games that's a given. Its not illegal to sell hacked consoles for home-brew but as soon as you are like " OMG EPIC HAXED PS4 PRELOADED WITH 120+ SONY PIRATED GAMES" you're asking for trouble. Seems like going after kind of a small fry though.
