if that was the case then dont you think everyone would do this?

The firmware is storage on the main system memory.
when you update your firmware the update unlocks this memory and writes the new update deleting the old one, then it locks it back down.

of course you can. either buy the games. or have fun with the several functions a 3ds can do. like using the mp3 player and taking 3d pictures and movies.
go to miiverse, have fun..
but if you want games, you have to purcahse them.

If you backed up your system NAND before you were on 9.4 you can use hard mod, otherwise your screwed for exploits!

Yes, NAND backups are console specific, unless you feel like bricking your ds of course!
