Back in 2009 the platform holder took French firm Divineo to court for producing DS flash carts that enable users to play non-authorised games and media on the portable, but it lost its original case against the manufacturer.
That decision has been reversed by Paris' Court of Appeals, which has issued guilty verdicts against Divineo, along with five other companies, for the importation, sale and distribution of game copier devices.
The Court imposed over €460,000 in criminal fines, damages payable to Nintendo in excess of €4.8 million and, in some instances, ordered suspended prison terms.
The ruling brings France in line with other European territories, including the Netherlands, UK, Germany, Italy and Belgium, Nintendo said.
Nintendo France managing director Stephan Bole commented: "Nintendo supported this criminal action not only for the company's sake, but for the interests of its game developer partners who spend time and money legitimately developing software for Nintendo's game platforms, and customers who expect the highest standards and integrity from products bearing the Nintendo name."
