Also, that's odd that it would arrive with 9.5. Maybe someone returned it before you bought it, and had updated it? I know some stores like to re place returned electronics back on the shelves.

amazon.de normally does not ship returned items as new, and i bought a new one, it also does not look like it was opened before (but i do not understand why there is no seal on the box)

...and how could someone update to 9.5 when this firmware was not even released until today, and it was shipped 2 Days ago...

n3ds consoles don't have seals, so it is impossible to tell if someone opened it, unless they left fingerprints...

Maybe you were just unlucky

Where did you buy yours at? Was also looking to buy a red 3DS under 9.4

do NOT take your chances with RED. there are numerous N3DS's at 9.5+ ....and only a few below 9.5

BLACK is the opposite. there are NUMEROUS models at 9.0 and 9.2 and there are just a FEW at 9.5.

seriously, don't be stupid. I got a red 9.5 n3DS from Best Buy and returned that shit and got a black "Target" version at 9.0 (below 9.2). And upon further analysis, the black is actually a light silver..which I like = ]

There are plenty of 9.0 reds available right now, though. It seems Nintendo's inventory is LIFO, meaning if you imagine a pile of N3DSs, the new units get stacked on top of the pile, but they also ship out first. Now that the pile is lessening, the older units are finally shipping out. Most day 1 reds were 40xx and now they're all 10xx, at least where I live. I'm unaware of any 10xx that is 9.4 of any color. If you order online, just make sure they have a good return policy

EU systems comes with Tomodachi Life, at least mine did (QEH1004). But no demo, whether it's the paper airplane video or Tomodachi Life, means it has been formated. In other words, returned to the store.

Was returned for sure, the 9.5 firmware is only 1 months old and that's today, no way in hell a new batch was assembled and shipped to EU so quickly.
