That's just speculation. He never said he wasn't going to release it, they're saying that if he does Nintendo will come after him, which has happened before.

If I'm not mistaken, uploads can be traced back by what I.P. uploaded the files. They can then find the I.P. to whoever uploaded it's computer, and viola, you have one caught pirate.

I'm glad he isn't posting the ROM, because it would hurt to see somebody do such a stupid thing, especially with all the attention he's getting on his blog.

Like someone said above, be patient, gtfo back to elementary school or whatever if you don't have the tenacity to look for sources yourself, and a release group will likely have it out by tomorrow.
