It is just the xbox that gets banned.
Your account can be moved to a new one without hassle (my friend did it after he got caught in the last banning wave).
You can also unban your xbox but it takes some serious effort, hardware and the 360s need to be homebrew capable.

Or when your player dies, you can say in code, if enemy exists, do nothing, but if enemy does not exist, then create enemy at certain spot. (This would be a pain tho for lots of emeies)+1 -

Easiest, simple way would be just restart scene, but player would restart from beginning.
