I added TubeHax DNS to my internet settings in my 4.5 sysNAND.
Why do I still get the update nag?

It probably means you already had an update downloaded before you added the DNS. Boot your 3DS into the recovery menu (I've forgotten which buttons you hold... Somebody will probably say) and then exit out of it. The update should be gone.
