Can I really get banned for using second hand Switch 2 games?

I was wondering because if I'm getting a Switch 2, I will most likely rely on the second hand market for games (in Canada, Switch 2 games have crossed the 100$ line)

If someone make a backup and then they sell the cartridge... there is a possibility of a ban.

The only thing I would watch out is for the one that has a switch 1 edition, technically the switch 2 cart will run on switch 1 and they can use a mig switch to dump games like BOTW, TOTK, Pokemon Legends ZA etc.

Yes, you can get banned by using second hand Switch 1 games on the Switch 2 AFAIK; if those games were ripped and are being used as "backups" by the public and Nintendo happens to know this (I guess because more than one person was online with the same rip). This has happened in the past as far as I know.

Also, IIRC, Nintendo has previously unbanned people that contacted them and showed they were using a second hand game and they had bought it without knowledge of it having been ripped and put online. At least this is what I remember I read back in the day from "very trustworthy sites like Reddit /s".

In my experience I was ready to contact Nintendo and complain if my console was banned when using a second hand game, I've bought and used several second hand Switch 1 games and used them on my Switch 2, and the console still remains perfectly fine. I would behave in the same way if I were buying second hand Switch 2 games: that is, just buy them, and in case something goes wrong complain to Nintendo.

@Noctosphere then again I been getting some of switch 2 games off ebay instead off retailer, even saving few dollars is saving few dollars.

I bought Donkey Kong Bananza and Hyrule Warriors age of Inprisonment off ebay sealed copy, I mean I am also afraid to take open copy.

As pointed out previously, but more directly: don't confuse Switch 1 cartridge dumpers with Switch 2. There's no such thing currently, the cartridges are different enough that no such dumper/flash cart exists right now.

If you do end up using the Switch 1 game second-hand market, make sure to keep any kind of proof of purchase (receipt? email? etc.) to use as proof if you need to get unbanned. The chances of that happening are extremely low, but better stay safe than sorry; a game you buy now may get you banned a year or two later...

Also, steer clear from game rental services, as the possibility of a S1 game that has been dumped is much higher. And of course, if you know someone with a dumper/flash cart like Mig Switch, come to your senses and if you suspect dirty business, don't borrow any games from them. In either case, there's practically no way to provide proof of purchase, so it's a dead end.
 
If you want to buy the games cheap, then buy them digitally from Amazon Japan.

I don''t think it is about buying them cheap, consider the fact even with the 1TB Micro SD Express you only get about 1.16 TB of space if you combine the system memory space with the Micro SD Express, if people can get physical copy if the game data are on the cart and not a game with key card they might go for physical copy.

Personally I prefer the faster loading times of digital.
I also don’t play all my games all the time, so when I run out of space I just delete what I already finished.
Not being able to resell is a negative though.
 
But how can they dump/ make backup of a Switch 2 game? I don't think it's possible yet.

it has already been explained by others at this point so no real need for me to go over it again, but neither myself or the OP said anything about specifically Switch 2 games. They said they are getting a Switch 2 and that most games would be from the second hand market... which includes an awful lot of Switch 1 games, which they could potentially get a ban from under the circumstances mentioned.

See my reply above. I never mentioned Switch 2 carts being dumped and the OP didn't mention buying ONLY second-hand Switch 2 carts. It's absolutely reasonable to assume that they would also be purchasing second-hand Switch 1 carts as there really aren't that many exclusive games available for 2. I'm well aware Switch 2 carts cannot be dumped. Didn't need an education on it.

Yeah it is a negative, I mean even if it is game key card you can resell it when you no longer want it, I was all digital on switch 1, I mean I guess I changed my mind for switch 2, considering how big switch 2 games are, I been thinking getting switch 2 BOTW and TOTK since they are on game cartridge even though I owned switch 1 version already.
 
If the certificate is taken from the cartridge and shared, of course there is a possibility of being banned. But I also know that by proving a legitimate purchase, the ban can be lifted. Obviously, this concerns the discussion that only applies to Switch 1 games; it can always happen to insert a Switch 1 cartridge.

Jesus Christ. No shit, genius? Perhaps I should have originally made it clear in my first reply that I was referring to Switch 1 games, but that has already since been clarified and you know it. As I already made perfectly clear, it's reasonable to assume that they would at some point also buy second-hand Switch 1 games. I thought it would be helpful information for them to know. But you know... feel free to continue to argue a point that's already been clarified.

No reason to act that way towards me, if you would of read the title and answered accordingly, we wouldn't be here. I only clarified that your answer was not correct, Switch 2 games cannot be dumped yet. You never stated that in your original post. ✌️
