Clone or not, if they program it by themself, to a certain degree it always will be similar to Gateway's.

Well, they could use a different Chip, their own Design, how to handle savegames and add features that makes it worth to buy a new card.

I don't think they will be faster, adapting to changes from Nintendo updates will take time and it's never good to rush releases > not to brick.
