if it was never system transferred over to your new console you have. You would need to contact nintendo to get it transferred over. If it was transferred before, then you would just need to log in.Also, this 3ds was purchased used and my own was sold years back, can I update the system and register this one to my account and get back my legallly purchased games?

Did you back up your save games on your old SD card using JKSM or Checkpoint? Because you can use those backups without any problem.dont even know how to take that from the Sd without JKSM
