If you took some time to fill out the questionnaire, you'd already have your answer ;)

Typically, the console is banned and not the account. The way to test this out is by logging into onto their website using the Nintendo Account linked to the banned console and trying to download/purchase anything to your Switch. After that, if you select Update Download Progress from Users, it will begin downloading whatever you got onto your console. Note that this will not work when you are superbanned (Atum banned).
Thanks for clearbig that up. Looks like I have been taught a valuable lesson. If buy a new switch are Nintendo following accounts around and re blocking new consoles that are linked to them? I’ll look at filling in the survey later today.

Ok I’ve spoken to Nintendo. Ther is nothing they can do to help me.

I asked if my account would be banned if I linked it to a different console but they couldn’t give me an answer on that. I’m planning on buying a new console but I will probably have to create a new account just to be sure.

This isn't exactly a noob-friendly questionaire, but I hope my answers are still useful. I've only ever used SX OS - no other CFW (wouldn't know how). Haven't played backups online - only games with online function I'm aware of that have been played are Just Dance 2018 and Mario Odyssey and those were legit physical carts. Everything worked - including eshop - until a few days after I installed Arcade Archives NSP titles under SX OS 1.4.

I can still download game updates, even under CFW. But online play has been "restricted"... we've only seen that error in Just Dance 2018 and Mario Odyssey. There is currently no Nintendo account on the Switch, and I don't plan on connecting with the banned Switch.

I quickly answered the first one. I took my time on the second one. However I don't see a difference on either posts if you can point it out for me. Well I do see SX OS being different but honestly I must have accidentally skipped it on the first one. I honestly don't even use SX OS but that one time for experimental reasons.

I realize that this is (hopefully) outdated news for most of you guys, but I just heard about this a couple days ago and I'd like to know peoples opinions on this:

It honestly seems to be that doing things like installing .nsp files and being careless enough to online with them is a 100% guaranteed ban, yet we have people who have done exactly this and are not banned (yet anyway). With the article being written by SciresM of ReSwitched, it seems quite genuine, and it really seems like when it comes to playing NSP backups, Nintendo knows exactly which people have done this. I can't help but wonder if Nintendo is just taking their sweet ass time issuing bans and we are all getting the banhammer sooner or later:/

Anyway, thoughts on this?

Installing .nsp files is a huge red flag. You can possibly get away with DLC and maybe updates only. They will round up everyone who is doing suspicious things on their Switch and ban them all at once

Ah I see. See I used an CDN downloader however I never used my own console certifications for it. And with the SXOS, I only used 1.3. The first time answered "SX OS Version when Online:" was someone else's answer that I left. And I never had a license so I just said no to the question. It also depends when you mean "online" with SXOS. I never even launched a game on SXOS. I had an active online connection for that one time use but that was really it. Only cfw I use is ReiNX with sig patches. Sometimes Hekate.

Console banned does not mean account banned.
I have been console banned for just launching and activating SX OS without having the Switch in Flight Mode.

I cannot access eShop or play games online, but I can still update games and firmware through the normal methods (local wireless play and news channel also work). In addition, I can login to my Nintendo Account through PC and even make purchases there (I just cannot download them to this console banned Switch). I was also able to login to my friend's Switch with my Nintendo Account and access my purchase history and re-download the games I had purchased. So if I ever want to get a new Switch (Switch XL or whatever revision they come up with), I could still connect my account to it and access my purchase history. My Nintendo Account also work on my phone.

So basically if you get console banned, it is essentially the same as being a "physical only" and not subscribing to Switch Online in September. That's it.

I simply launched SX OS and activated it while having my Switch normally connected to Wi-Fi. Then I started playing my legitimately purchased games from the eShop (in fact, I only played YS VIII: Lacrimosa of Dana) on SX OS. I made sure not to play games online (ARMS is the only online game I own and I have not played it in 6+ months) or check the eShop while on SX OS. The next day I decided to reboot my Switch and check the eShop on the official firmware and I found myself being banned. So the way I see it, the reason I got banned is because I was running SX OS without having the Switch in Flight Mode.

If I buy a new switch and register it with a different email will it just work as expected.
It should to be honest. Nintendo has no reason to ban consoles running from the same IP. Just because one person from the family hacks doesn't mean everyone else is. Also, still waiting on that report ;)

I won't say they don't do that, but I honestly believe it's unlikely they are logging RCM use. That would open the possibility to ban people who had their system repaired by a third party. It would take one accidental power on with the eMMC disconnected to trigger an RCM flag for ban. Also very unlikely they could have any good way to detect a payload being run through RCM as opposed to just an RCM trigger.

So what do they use to determine if the console has been hacked? Cleared log, 'weird' entries in log? If ReiNX runs on the RAM or sd card it shouldn't leave any trace after the console is turned off, only in the log, unless it writes something somewhere else.
