Factory reset doesn't protect you sadly as the information afaik is still stored somewhere and will be sent when you go online, the only solution is to reflash your NAND again prior to going online and this time not load CFW, if you've gone online since the factory reset then all you can do is pray they spare you.
Though you may get lucky and fly under the radar but that wouldn't be a chance I'd take if you only have one switch.

edit:
Making a nand backup after you've booted into a CFW even once is unsafe and means it's tainted and not clean, this is why you're supposed to make the backup before you do absolutely anything.

Both ReiNX and Atmosphere now use creport but creport won't help for error codes generated before you use it.

In my case I only boot one time in sysnand with atmosphere and another with ReiNX (both offline).

Do you think I risk being banned?

I'am noob on switch scene, when you say "error code" it is a in switch screen error ou a hidden error (in the hidden nintendo logs)?

It is error history under setting, so they can tell if issues are related to CFW or unauthorized software, so they will be uploaded to Nintendo server for screening and alert the support if there is red flag, so they will ban if there is evidence of CFW. If you use Atmos with creport enabled, so error codes will go to SD card so it won't go in NAND.

Also Atmos blocked telemetry report, so Nintendo relies on telemetry to determine if you use CFW or not.

Can Nintendo ban my console that has never had internet setup and has been in airplane mode since day 1? Someone is arguing with me that Nintendo can ban your console even if you never go online.

To add onto what Shikkichu said, staying in Airplane Mode without Wi-Fi settings is like banning yourself. While one may say it is a temporary ban that you can remove at any time, I would argue the reason you are staying offline is because if you went online in your current situation with CFW and homebrew, you would risk getting banned. And you'll never find out if you're banned or not if you stay offline effectively continuing the loop of not knowing if you're banned but banning yourself because you're too afraid to check.

Then that person really doesn't know what they are talking about. If wireless communications were allowed in Airplane Mode, that's a sign of a defective product/service that could lead to a lawsuit.

I have a few questions regarding updating and banning. Please bear with me for a bit while I explain where I'm at and what my goal is.

Background:
- I have never installed or run any homebrew, xcis, nsps, etc. on my Switch.
- Every game I've played on my Switch is a legitimate physical cartridge and 1 eshop purchase.
- What I HAVE done is start into RCM last year while on firmware 4.1.0 to back up my NAND using Hekate, enable AutoRCM, and manually update to 5.1.0 (which was current at the time) so that I could download game updates. (This was before ChoidujourNX was released). I continued using the stock firmware with AutoRCM enabled.
- My Switch is still on 5.1.0 with 5 fuses burned and has remained offline since just before the 6.0 firmware push.
- After reading several months ago that Atmosphere blocks telemetry and prevents firmware updates from disabling AutoRCM, I decided to copy the Atmosphere files to my SD card. When I booted up, I saw the Atmosphere logo, but I don't remember anything more about it. It would have been just whatever default settings. My intention at the time was to update to the 6.x firmware, but was too uncertain about it, so I never did. I've still not gone online since the 6.0 push last year.
- About a month ago, my wife finally turned off the Switch, so I used Hekate to boot the stock firmware again (AutoRCM still enabled).

Where I'm at now:
- I've collected a LOT of cartridges, but everything since early March requires a firmware update.

My goal:
- I want to preserve my fuses.
- I want to avoid a ban because I still have several download codes for games and DLC that came with purchased cartridges that I need to redeem (such as Bayonetta, Resident Evil Revelations 2, etc.)
- I want to update so I can play my more recent purchases.
- I'd like to be able to download game updates, but I've probably missed the boat on that for now, since 8.0 is out and it sounds like I should avoid that for now.
- I have no interest in piracy, and currently no interest in homebrew, but I do want to keep my Switch able to run homebrew in the future.

Questions:
- If I boot with Atmosphere, will the telemetry blocks make it safe to download game updates? Are there any custom settings that need to be set, or is the default okay?
- Can I update the firmware online with Atmosphere running to keep AutoRCM and prevent burning fuses?
- Should I boot with Atmosphere and do a system update from a cartridge? (I don't know if these cartridges include a firmware update, or if they're just wanting me to download if from online).

I cannot say with 100% guarantee that it will be perfectly safe however I have been updating my firmware in Atmosphere with AutoRCM enabled to preserve my fuses. For game updates, I never download them while running Atmosphere. I always download them in Hekate's Stock configuration. In fact, I do everything online from Hekate's stock profile. I download the firmware updates in Stock mode then install them offline while running the CFW Atmosphere. I have been doing this for a few months and so far, I haven't been banned yet but your mileage may vary.

System updates are downloaded automatically while your console has a connection to the Internet but never installed automatically. Simply leave the console running with an Internet connection for a couple of minutes and check to see if a system update is pending which you can by trying to check your system firmware. I also didn't change any of the settings in Atmosphere. The one that preserves AutoRCM is applied automatically and cannot be disabled anyways.

And updating to 8.0 while preserving AutoRCM will prevent you from booting the console into CFW/OFW since no bootloader can boot firmware 8.0 so might not be the best idea.

And updating to 8.0 while preserving AutoRCM will prevent you from booting the console into CFW/OFW since no bootloader can boot firmware 8.0 so might not be the best idea.

Looks like Atmosphere was updated today, so maybe I'll get up the nerve to try updating later. :-)

I update all my games while in custom firmware mode. I just don’t open the NSPs i installed outside of the eshop while in custom firmware online. I’m still not banned and I’ve been doing this since 4.1.0.

You're one person. There are hundreds if not thousands of Switch CFW users. People have both been banned and not banned for the same actions. The conclusion is that bans are random and the safest route is to either not hack or restore a clean NAND. Just because you're not banned yet doesn't mean what you are doing is safe.

I think i discovered a new cause dor bans. When you play any game(even on emunamd) the switchs firmware records it. When you go online, nintendo can use the hash code linked to the serial code number to ban you, as the firmware is linked to the serial code and sends the records of the games you played to nintendo, if you go online. And if you ran any illegally downloaded games (even on emunand) it is recorded on the firmware, which sends the data to the RAM, on the mother board of the switch itself. Go online, and ninty will ban you via the hashcode linked to the switches serial code.
