And how did Nintendo detect?
Well that is sort of up in the air. Data collection during the initial banwave went from non-existent to extremely vague. We were able to determine people were banned for using LayeredFS both offline and online but that could be attributed to many different reasons such as error codes or having save data for a game you don't own. And since most of those only made accounts to share such information, we may never find out why these bans occurred but its been generally accepted that using LayeredFS to load backups is one of the most reliable ways to get banned. Its even labeled as dangerous in the OP.

Theoretically then if we delete save data from games that we don't own every time and since atmosphere paches creport
then we should be fine????? Maybe

My guess is, LayeredFS was responsible for the bans... TOO MANY ERROR logs for things Nintendo didn't implement...

Its not worth testing for several reasons:
  1. We have native backup loading with .XCI and .NSP files
  2. LayeredFS is a nightmare to setup for backup launching
  3. The risk for using LayeredFS to play backups still remains as we never identified a root cause

So in the past, it was possible to go online and still preserve your fuses, by booting "STOCK" (OFW) in Hekate.

This seemed to be "safe", in that no one got banned for just having the wrong number of fuses.

This is actually my personal setup since...whatever day I put into the spreadsheet. I downloaded the 6.2 system update, booted into Atmosphere, and installed the update while I had AutoRCM so I could update without burning fuses and using homebrew (e.g. ChoiDujourNX). Ever since, I have been booting stock via Hekate and no ban insight. If I do get banned, I will let everyone know how potentially unsafe this method is safe but as CTCaer states, this is relatively safe.

Never thought of that.

But still, my XCI only strategy is keeping me safe.

For example let's you're on fw 4.1.0, you make a Nand backup, now you update with ChoiDujour to 6.2
Now the switch will ask you if you want to update controller. You do that since the controller fw doesn't really matter(?) from what I heard.

But if you later on restore your Nand to 4.1.0 your contoller fw will not match with your console fw anymore.
Since your controllers will have a fw that could not be there with the fw 4.1.0

Just my thoughts.

There is no evidence Nintendo scans the SD card so removing everything off the SD card would amount to a waste of time. If you don't have a clean NAND backup, you cannot go online without risking a ban simultaneously.

The only safe way of avoiding bans is to revert to a "clean" nand backup before going online. If you don't have a NAND backup though, and you want to play online, you might as well remove any illegit NSPs (and possibly related save files), remove your CFW, update to the latest version, and try. The WORST thing that could happen is you getting banned, but if you do get banned, it was inevitable.

Or you could just stay offline and not get banned. But whether you get banned by Nintendo, or you "ban" yourself by not playing online, either way, you're not playing online. So you might as well try if it's something you care about.

You can also create a clean nand, with ChoiDuJour for PC, there are some tutorials out there on how to recreate a nand from scratch, without any trace of CFW. C:

I have one switch that's not patched i got it before the patch for new systems. Its on 7.0.1 and i have a bunch of games i wanna keep playing online but i always wanna hack my switch iv always been on the hacking scene when it first started from 3ds immediately i hacked it did some cheats installed some roms and other games but i hear now that people are getting banned from online and there switch are getting banned. I wanna hack my switch but is there anyway i can prevent from getting a ban or have the lowest risk
