Isnt there a saying that even going online after using fbi cia and not a legit game is risky of bans that ppl prefer to hide fbi behind rosalinna ?

Well I mean it's not 100% guaranteed you'll get banned, but it's better if you avoid it from now on
Villain3DS is awesome, use that while it still works

Download is the focus, not pirated games, you're fine with online

Well, the saying is there because there's always a small risk with CFW, but so far there are a lot of people with CFW which haven't got banned

So I just want to get this straight. I'm fine downloading updates and legit games through eshop even if I have non-legit stuff still installed on my 3ds?

Thanks. Just a quick question sorry if it's already been answered:

If i have already cia downloaded games with freeshop can i keep them or will they ban me in the future? Or is it just after the update where downloads gets you banned? I am on 11.7

No they won't ban you if you keep games you already downloaded

(I think for Nintendo it's no difference if I use a CIA from my own cardridge or from a piracy-side. Nintendo don't know, that it is my own dump?)
Or other way asked: Is DLC and Update / Patch the same thing?

I read, that after the update dsimenu++ isn't working anymore. Is that correct? I have now Luma3DS v9.1 installed. Should I do anything more?

It says in the main post, installing CIAs with FBI is safe.
Idk about DSiMenu++ since I don't use it

What kind and error of ban you'll get if use freeshop? A LocalFriendCodeSeed_B ban or a console ban? (or even a NNID ban?)

Can Nintendo detect if I have/use non-legit applications on my 3DS and ban me that way (eg: Homebrew)? No, the data is only sent when downloading the game/DLC itself from the servers. No data is sent when launching applications.

I have the same doubt. It seems incoherent to me that they would be able to catch block you from downloading a game but wouldn't be able to catch you downloading an update for the game you can't really download.
Unless their servers can't differ cias from cartridges, in which case I still would have my doubts with eshop-only games.

usually update for game are the same for cartridge and for eshop game, and you can usually download them normaly from eshop even if you dont have the game, so i guess it is safe for this reason : its free stuff with aquisition not linked to the base game

Anyway, you Nintendo won't be able to tell when downloading a patch if the game is legit. In fact, you can also download updates from games you've never played/owned on the console
