From where I sit third parties never really gave the Switch much mind/attention and it is already dropping off a cliff.

Wouldnt the second hand sales also kill a console? Basically 1 sale can lead up to 5 sales afterwards with no income for nintendo/ the third party.
The option to sell things second hand is enshrined within law and vigorously upheld. To that end imagining what would happen if second hand did not exist is possible I guess but of no practical use at all -- it is there, it has essentially always been there, it probably always will be there, it considered a perfectly moral act* and will have been there from the start and can predicted to be so too. Imagining what might have happened if someone actually knew security on the other hand can be done. It is extremely hard to determine with numbers what any effects might have been, and may vary with time/outside factors, game, company and style of hacks available, to say nothing of potential positives (a bunch of pirates may make for an alive server sort of thing**), and in any case resists a simplistic analysis but something could be said.

*I was around when I first saw that argument floated many years ago. I laughed then but I am still shocked it actually caught on and persists to this day.

**see what might happen to servers if a game goes free on PSN, humble bundle or similar.

So you're just agreeing with the fact that piracy doesn't affect overall sales numbers,

No, I'm saying it's impossible to quantify the effect of piracy because it's too complex. How are you able to test with and without piracy in isolation? It's therefore impossible to come to any conclusion from any studies that have been performed.

The courts & copyright holders understand this, which is why you get statutory damages as a deterrent and punishment as seeking actual monetary damages per infringement is impossible.

If the best Nintendo can come up with is splatoon and a bunch of ports than who really cares! I won't be buying a switch just so I can play Mario odyssey which is the only decent title worth paying and playing on the platform.

They earn cash from buying the console and accessoires. Furthermore I bet most people on GBAtemp purchased games in the past so they have sponsored nintendo. It arguably could, which is why they tried to stop game rentals and second hand sales. They didn't have much luck, other that to stop photocopying of the manuals https://www.upi.com/Archives/1989/0...ht-lawsuit-against-Blockbuster/5167618206400/

As they have the legal right to authorise copies, then it's much easier to argue against piracy.

I personally don't see the switch disappearing just yet, but it might make them think about introducing a more powerful switch sooner than they intended and that can have consequences.

As others have said, the 3DS proves this will likely not be the case. Incredibly easy piracy has been available on the 3DS for a very long time and they still released huge titles on it (Pokemon, Metroid, Zelda, Mario Maker and more).
Just look at PC gaming, every company is releasing PC versions of games even though 99.9% of PC games are cracked in the first day they're released. The reality is, a lot of people pirate games because they simply can't afford the game or would never purchase it to start with so you can't look at how many times something has been pirated and think "Okay, this company lost out on NumberOfDownloads x $Price" because someone pirating something doesn't always mean a sale was lost since not everyone that pirates a game could or would have purchased it anyway. Companies obviously know this and that's probably why most of them don't shell out money on anti-piracy like Denuvo etc. Piracy will obviously lose developers some kind of money but I really don't think it'd be enough for developers to stop development on the switch.

even more so with games nowadays always getting more and more expensive

PS1 was not killed by piracy while modchip wasn't really hard to get
PS2 was not killed by piracy while modchip + swapdisk was easy to get
PS3 was not killd by piracy while CFW and modchip existed
PSP get a long life and many good game while it was easy to hack
DS was not killed by piracy while r4 was really common
3DS was not killed by piracy, whereas cfw are easy to install, and flashcard still exist



PAtched switch are now out, in few years, less than 25% of switch will be hackable so I don't think It will make a big difference

From all the replies this is the most inconsistent and childish. If you can't afford something at the moment doesn't mean you have to steal it.
For what concerns the other replies I appreciate the answers and the new points of view you gave to people facing this dilemma for the first time.

lol so if you cant aford it you steal it? that is a very good point to teach everyone i got a car i dont have gas money i can just steal gas and im entitled to do so because i own a car but cant afford the gas...


anyway most people that pirate games wouldnt buy all those games only a fraction if they even had money.

heck back on wii i pirated alot of games but most games i didn't even bother to finish because i ended up not licking them, the games i really liked and finished i bought them after for my collection so basically i pirated to see if it would be a worthy buy.

You're confusing two different issues. It's your choice whether you wish to pirate software.

What you can't do is pretend that you have proof that there is no consequence to piracy.

I don't think the switch will collapse just yet, but it's entirely possible it's life has been shortened by six months.

Piracy is good for a console, because it boosts console sales and Nintendo never suffered through the blatant piracy on the Wii (they suffered before piracy on the WiiU), so it should be the same on the Switch where the console sales alone keep the system in production (plus piracy is in a small fraction).

OP, how do you come up with a fact like that the Switch got Piracy not even a year after its release? It was released in March 2017. SX Os happened in June. People already said that Ps2 and DS had piracy very early on. Wii as well. Also PSX, where you didn't even need a modchip or anything, just a 1:1 backup and a paper clip (it's all coming together now) - also Xbox 360 had Piracy just over a year after its release with flashed drives. Iirc all those were furiously successful.
Just think about how many owners of a system pirate. Maybe one in a thousand, one in 500 tops? And then think how this would seriously threaten the system.

I don't know about other systems, but the 3DS seems to be in a situation now where it's still moving a lot of consoles yet barely any software is coming out. Piracy has to have some role in that.
