There is always a risk, whether you use .XCI or .NSP. The risk may be higher with a .NSP since Nintendo can cross check if you own the game (but it doesn't seem like a feasible option what with 18 million users to potentially cross-check).

I'd just assume if you're going online with any hacks running, just assume its banned and enjoy it while it lasts

They could've done this with the 3DS and no one was banned, like ever!

3DS had other problems with it namely that requests to the eShop could be made anonymously so they would never know who was downloading what. This is why Freeshop succeeded because they didn't implement any checks if requests were made outside of the eShop.
