I would argue no since Deja Vu is reserved for Mariko Switch units. If they release it now, Nintendo can patch it out in the next firmware update and launch those firmwares with Mariko units. Just buy from Walmart or Gamestop, if you plan to buy a Switch in the US. If your Switch is hackproof, return it, and claim the joycons desync(I'm sure they had Switches returned before over that issue), the employee probably won't even bother checking, esp at Walmart.

Nintendo intended this to clear up the first batch (hackable console = more sales)

We are basing this of user reports, I have personally had two people asking me to help them with new Switches and its been impossible to get the payloads to work, thus they must be patched, several others have also reported this.
