Okay so here's the facts, feel as if I would make this a thread to help contribute... Let's see how this goes.

With the information I've gathered, its not your firmware version as you can be banned on 11.2 and up or down, A9LH, Boot9Strap, FreeShop, Spot/Street Pass, Activity Log, Friendship sharing activity, or anything to that nature, or even a specific titled game.. none of us played unreleased titles, or even new released titles like FE, we stick to the basics and stay outta the way. The only way it IS freeshop is if its BAD CIAs? but not all of us are banned so it doesn't add up either..

I have a 3DS that I've had for approx 72 hours (I've had other 3DS XL's in the past, sold them off). So this is brand new hacked, and I did a System Transfer and got my NNID on it now too.
I have 2 other friends that have 3DS XL's and we've all been hacked w/ CFW for months.

None of us cheat, or use save editors, some of us are on A9LH, some of us are on Boot9Strap.

Myself: Boot9Strap 3DS 11.4 Not banned, typical Freeshop user updates/dlc/games, and played smash bros online for approx 10 mins. I've used the console all around for approx 2 hours according to activity log. I do not share info w/ nintendo and have spot/street pass off etc, I don't like sharing anything and anyone seeing anything. I'm private AF. I HAD friend share, where they can see what I am playing but I did turn that off just now anyway.
Friend #1: Same as me, 3DS but XL 11.4 BANNED THOUGH, played Zelda triforce heroes and mario kart online, never cheated, nothing, was on A9LH and switched to boot9strap.
typical Freeshop user updates/dlc/games.
Friend #2: typical Freeshop user updates/dlc/games, 11.4 3DS XL, A9LH not banned, now this friend submits everything to nintendo has spotpass on street pass the whole nine loves it all.

So with all that being said. The only other thing I can think of, is nintendo is having something slowly pickup on writing to NAND in their software and is banning, and gathering information - yet not ALL of us got banned and we all play, and all do the same thing, except friend #2, goes wild and isn't banned.

So really, at finding out WHAT is triggering this, is going to be ridiculously hard.

Please if you're giving input, use your brain, we don't need ANOTHER flooded thread where people aren't working together

They seem to be able to tell whether you have a modified console or not and they probably made a list of some, but not all people, maybe they only collected info at specific times idk.

It's pretty random, but there is the possibility of everyone with a modified console being banned in the future

They seem to be able to tell whether you have a modified console or not and they probably made a list of some, but not all people, maybe they only collected info at specific times idk.

It's pretty random, but there is the possibility of everyone with a modified console being banned in the future
I bet the last updates, I suspect 11.4, has some code hidden away that actually reads what titles you have installed, compared their tickets from your NNID and the ones from the games installed on your console, and determine whether it is a legit copy or a pirated one, I mean, it DOES make sense...

Bans are probably being made using machine learning, which is why there isn't a consistent variable (other than CFW).

Factors that probably weigh heavily on whether or not you're flagged:

1. Title sharing via friend list
2. SpotPass enabled
3. Suspicious eShop activity
4. Out of region online activity

Probably not much you can do. Bans will most likely come in waves. This data has probably been collected for some time now.

This code has been around for a while, the spotpass share info with Nintendo option has sent the HomeMenu extdata for a while, which includes all installed titles. We also know that Nintendo has a list of all released TitleIDs available on hand, so if you have one that doesn't match this it wouldn't be surprising if that's how they're doing it. AW's poll also shows the people who have the spotpass option enabled being banned far more commonly than others which also supports this theory.

People who haven't used their 3ds in over a month have been banned, which makes me think this data has been collected for a while.

It could be that all or most versions already had this, since some people with older FWs got banned too
Hmmm, probably... maybe the damn thing keeps a register of executed firmware versions and sends this info to nintendo? Then they ban people who had modified their firmware in any shape or form.
Heh... not into programming but anything is possible when you are at war with programmers/developers who actively hack your console.

I have a question - part of bypassing the Sun/Moon bans involved changing your console serial number in SecureInfo_A. If someone who modified that got banned again, would someone with a console who just happens to have a 3DS with that serial number also get a ban?

Yeah, so it wasn't something hiding is 11.4 specifically, could have been sitting dormant for many FWs at this point, like people have theorized collecting data and biding its time.

Some people claimed they were.
That doesn't mean you aren't flagged. Some known CFW accounts may be left unbanned and monitored to create a better model to more accurately identify CFW user's activity trends.

It's been coming in waves, it's possible either you somehow evaded the list or they haven't banned you yet.
exactly, "yet". I am not banned "yet" either, and staying offline might do absolutely nothing for me as they might already have my info and I am on the next wave waiting to crash. It's a wait and see. I would love to know what is triggering this though. Because if its something we cannot control like a unrecognized write to the SysNAND, we're all screwed waiting for the titanic to sink

There was no reason for this to be in a separate post, just like everybody else, you have no idea what criteria they are using to ban people.

Surveys show that it seems to affect mostly people on firmware 11.2+. We don't know how long Nintendo has been collecting data and choosing which 3DS consoles to ban. They might have a huge list of pending bans for all we know, in which case for your "unbanned" friend it is only a matter of time.

And since we don't know who may or may not be on a pending ban list, that may or may not even exist, we have no definite proof of whether the bans are related to StreetPass, SpotPass, Activity Log, or Friend List. It may be a combination of things. They may have been building a ban list for months for all we know.

You might not have played any games before release, but that means very little with the data we have at this point. You've used FBI before? Homebrew Launcher? You've already admitted to FreeShop. The title ids are in your activity log, if Nintendo has been keeping copies of people's activity logs it would be very easy for them to figure out who is running unauthorized software. If they gathered a large enough list of consoles to ban, and then just started banning them in completely random waves, it would result in the exact same ruckus we have going on now. Bans across multiple firmwares, using multiple CFWs and exploits, with seemingly nothing common among every case.

I don't have any way of knowing exactly how they've implemented these ban waves, but if I had to bet money on something, it would be the Activity Logs and/or Friend Lists (particularly sharing which title you're currently playing).

I mean all the games are still playable, you just can't play online, and really I dunno about you, but I never did much online gaming with my 3DS as it is anyway. The only game where this is a big bummer for me is Super Mario Maker 3DS, but I have the Wii U version too, so its not like I can't still get the full Mario Maker experience as it is.
