holding on to the 9.3 update? or has it been downloading newer updates in anticipation of me accepting the update? I don't keep my wifi off anymore since the update first prompted me many months ago. I've never tried to update it past 9.2

The reason I ask is because I'm considering getting a gateway and from my understanding, I need to format my emuNAND as part of the process. Unfortunately, in sysNAND at least, you can't format unless you accept the update and right now, 9.7 [apparently] isn't supported by emuNAND.

But if I have the 9.3 update in sysNAND, the emuNAND format should carry over that 9.3 update, meaning if I accept the update in emuNAND, I'll end up on 9.3, then I can system format a working 9.3 emuNAND and be all set, right? This is all assuming I end up getting a gateway a some point

You can format without updating. It will ask you to connect to the internet (I forgot why, something to do with eShop purchases or something), but it won't actually update.

You can get rid of the nag screen as well.

Power up the system while holding L+R+A+Up on the Dpad and click cancel when it prompts you to update.

You can format sysNand without accepting the 9.3 (or whatever version it may be asking for) update. I recently sold a 9.2 O3DS XL and formatted it successfully :)

The reason it asks to connect to the internet is so that it can unlink your NNID on the Nintendo servers, I believe. Supposedly you're not able to use the NNID without relinking it if both emuNAND and sysNAND have it linked and you format one or the other.

yeah there was some confusion originally about it asking to connect to the internet to format (as nobody really wanted to risk it), but as you probably already know by all the people who already answered it doesn't actually take advantage of the opportunity to enforce a system update, it only requests internet access to unlink your NNID
