Because we still don't know if the new 3ds gateway exploit (if it is released one day...) max supported firmware will be 9.2 like the normal 3DS or 9.4...
There is zero reason to think 9.2 would be supported and not 9.4 the changes made in those updates were to block an exploit in the 3ds browser. The n3ds uses a different browser.

Yes, they don't use the same exploit, but apparently the browser exploit was not the only thing which was modified with the 9.3-9.4 update, both for 3DS and N3DS...
Sadly because of the lack of news from gateway (which is a very bad sign I think...), we will not know before they release it "soon (TM)".

the browser exploit isn't blocked on 9.4, (or even 9.5 for that matter), what i don't see is why people who don't know the technical details would just say random stuff with no foundation, the gateway exploit uses 4 separate exploits to gain its control over the system, only 1 stage was blocked, but it was a important part of the whole package........could gateway have a secret trick up their sleeves that will be able to work on 9.3+......nobody knows, but as its stands a important part of their exploit was patched in 9.3 unless they have something else that will allow total control over the system i wouldn't go around saying 9.4 is likely to work, as it most likely will not, and even if gateway did have a ace up their sleeves im sure they would keep hold of it for a good while until 1.0-9.2 systems become rare or once they think the time is right, i.e if new encryption is introduced down the line, its better to have a backup plan than to cater to the 2% who found them selves on 9.3+

I think it's actually in the middle of the chain (so stage 3 or so), I've read a bit more in this since posting this comment. Stage 1 is your browser launch which still works as evidenced by regionthree working on the nn3ds. Agreed that we shouldn't be catering to 9.3+ as there's not any real reason to be on that FW if you're actively trying to use a GW card.

Since when regionthree is working on N3DS?? I would love it if it was the case! (regionfree on N3DS being the only reason why I am waiting for gateway update)
I might not no all the technical aspect, but from what I have been reading the N3DS doesn't have the same browser, main reason why they couldn't port the ~9.2 exploit on the ~9.2 N3DS easily...
Now indeed the 9.3+ updates, even so they don't block the browser exploit, seems to block the other stages.
That is why I am worried, even if they found another stage 1 exploit for the N3DS (Mii channel?), the other stages might be blocked on 9.3+ too like on normal 3DS.
But I might also be wrong, since it is very hard to find any reliable piece of technical information about the gateway hack...

Anyway even if they don't release emunand and even if the exploit mess up with the Mii, I would be very happy if it could only allow me to launch my EU games on my JAP N3DS. (and no, sadly I couldn't get a EU or US N3DS, since I am living in japan...)

Smealum wrote a fair bit about the gateway stuff, afaik ninjahax works on the nn3ds too, haven't tried it as I don't have a copy of cubic ninja. On my phone atm so it's hard to find the info but it's been posted in the past.

As far as I know, ninjahax was blocked on 9.3, and regionthree doesn't work at all on nn3DS...

Now I am really wondering if I should sell back my zelda 3DS asap and get a standard one with ~9.2 or just wait more... because I am pretty sure that if I sell it now and the update for 9.4 N3DS comes out, or if I wait and it never comes out, I will regret it... damn gateway and their lack of communication!! They could at least tell some info about the most recent firmware they could support for sysnand!

OK then after all it ended up being a terrible choice. I still can't use any of my EU games on this 3DS, and because this limited edition here in japan was not so "limited", and because so many people are selling it on amazon, it makes it almost impossible for me to sell it, except at a lower price that I bought it maybe...
Therefore it just became a very pricy and useless piece of technology taking the dust on my desk... Which is a shame when I see how beautiful this new 3DS is.
If at least there was a way to remove this annoying region lock...
