I think the closing up shop of the most popular flashcard reseller in the US is probably another clue
Maybe Nintendo decided to lean on them because they know it is shipping with under 9.3

very true, but it may be shipped with a message saying that you require an update to use amiibo, but in japan the video said amiibo support, yet it shipped with 8.1, even though 9.0 was out at release (well, it was released before the new 3ds was released)

I cannot answer your question, but I went out to the holy land that I christened to my gods (which is my backyard, my neighbors didn't like me "annexing their yard for the almighty" for some reason). I prepared a roaring fire to send signal flames into to the sky to ask the gods what firmware the n3ds would have. The gods have responded to me in the form of a $920 fine from the local government for not being zoned for having that kind of uncontrolled burn in city limits. I take this as my gods telling me that the n3ds should come with 9.2. Hopefully this answers your question.

Maybe I will take a ride to lamestop later and see if I can get the MM demo to boot to the home menu by doing the hold start select L plus R trick
Not sure if it will still work on the N3ds but I will try it and then if it don't work try also holding the 2 extra z trigger buttons too
Then I'll check the FW

Nope it didn't work but I got there like two minutes before they closed and the guy working was a dick and yelled at me
Also I couldn't get it to power off it that's weird cause the other day I was there and I could swear when I asked them to turn it off and on again that it turned off it has some wires goning into it connected to a kiosk maybe that was turned off or something the other day but anyways someone who got one early on YouTube said his came in 9.0
