If the design is considered a trade secret and is well-within the timespan of patent protection then yes, yes it would be industrial espionage as silly as it sounds. Delayering a CPU can only be performed on an industrial scale, it's not something "anyone" can do. Anyone can "crack open" a can of Coke too, but you won't perform a chemical analysis of the "secret ingredient" which is protected to this day.
Besides, this isn't about the complexity of the task, rather about the legality of sharing your reverse-engineering results.
If they did find a perfect exploit they would not give it you. They would sell out to highest bidders stuff like that is worth big money they might even ask Nintendo to pay them not to release it. A fair few company's just like the gateway team would pay big money for fresh exploits as big money can be made.
The only reason its likely not self funded in hope to make money is because they skint. It's likely already been done by other companies anyway and nothing of use found. Spending £2000 for info you can make 10x+ on is too good to pass up on so yeah someone has tried it in the past anyway.

If it really were confirmed to be a scam, I would assume that the site would have removed the page to prevent any further victims. So rather than being a useless leach who has never contributed to the scene in any way, some individuals decided to take the risk and invest in this venture, with hopes that some progress will come to fruition. Intentions may vary but that is beside the point. If anything, this is essentially a Kickstarter-esque event, without the mediator that is Kickstarter due to the nature of the intended action.wow i laugh at anyone who donated for this,it was stupid since the beginning,no one else ever asked for money to scan a console to be able to hack it before but sadly it worked and some people got ripped off .....too bad LOL

Then what would be the point on decapping it if they asked Nintendo to pay them not to release it? It's a waste of time if you ask me. Is it one of those "Just because they can?" situations?
Nope it would be something like an exploit that they managed to create due to the decap. They could Tell Nintendo how they can exploit the system in exchange to keep quiet. Many security firms offer this "Service" A fair few companies such as Microsoft and google encourage you to hack there systems and offer you cash to tell them how you did it so they can fix the bug so its not open for others to use.
Nintendo will see an unreleased exploit as an early opportunity to create a fix before its public knowledge. This is worth money and lots. The exploit would be worth loads of money for companies like gateway and mean much lost profits for Nintendo. So yeah given the chance to buy something before its being released they would take it be nuts not to.
Then they shouldn't have asked for donations in the first place. It was a lost cause. Why bother telling people that they're going to de-cap it if it's only going to end up being fixed?
