I remember reading about this last week. They said that if Ninty does CnD them, they'll swap out all the Zelda trademarked toons and icons and put originals in its place. Then it would be no different from the many Graal based games.

Did this achieve any kind of notoriety?
I vaguely remember it's been mentioned, since quite some days actually, in some not too minor gaming blogs... maybe this site, not exactly a small one, too? :)

I also received, no idea about the level of coincidence, a dmca on google drive for a pretty unpopular (ie: barely 3 youtube videos) Pokemon Crystal hack despite having hotter stuff in the same account and even folder!

My personal rules for making fan games:
-never announce development. Only announce completion
-no public recruitment, only private
-don't make any announcement until the game has gone gold and been spread to loads of people who will propagate.
-If possible, don't add any potential copyrighted characters/stuff until the end of development (placeholders until it becomes dumb to keep them)

I personally like the idea of creating a "vanilla" version free of copyrighted materials, then spreading an "update" that adds in the fan-game visuals/music/sounds/etc.

Sad to see this gone, though, seemed fun.

Well, have anyone thought about making a complete fan game, and DON'T say anything about it, only AFTER completing it.

So when you release the full game, even if it gets C&D'd, fans will have a chance to download the whole thing even if it gets removed.

In my opinion, it kinda sucks and at the same time, it doesn't.
If you had a brand, and someone takes advantage of it (monetary or non monetary) wouldn't you defend what's yours?
But honestly, making fan games is an awesome way to say:
"Look Nintendo! We love your games. So we took perhaps two years of our precious time to make you a game to show you our lo... Ok, I'll remove it... :("

But then you don't get all those downloads because of playing off another IP.

I'm not trying to be a narc, because I don't care. Out of curiosity though there is no legal issues with freely sharing the game right? Since Nintendo didn't make it and the makers obviously could copyright it right? Or would it be the same circumstances that lead Nintendo to DMCA the originators?

Zelda Maker is coming.
I would be curious to see them pull that one off, especially after the somewhat sub par/limiting approaches Mario Maker took. Mario levels you can almost iterate "screen" by screen or set piece by set piece but Zelda games seem to want to have a bit more of thread within them.

ok first off nintendo does have that right. HOWEVER. if someone is making good fan games for free. don't you think that actaully only advertizes the main franchise. AND SERIOUSLY who is dumb enough to not know that zelda or mario belong to Nintendo! If the creator of the fan project is saying "all characters belong to Nintendo" then why! why take it down. The guy is literately giving free advertising for the series. When people make fan games it can in a away advertise the franchise they base it off of. Nintendo is by far one if not the most thicked skulled companies. Don't they see, this is a lost opportunity to gain revenue! Don't take it down, let it spread so people who never picked up a zelda game. might actually buy the real thing!

Tip to not get DMCA on your fangame: don't get popular.

Think about it. SM64 Unity, AM2R, Pokemon Uranium/Prism, Legend Maker, etc. all got tons of news articles and YouTube videos by gaming sites, praising games for being "free Pokemon/Mario/Zelda games as good as Nintendo's" which gets it into Nintendo's view, and promptly killed.

Of course, what many of these devs want is that recognition, so that when they DO get a YMCA DMCA, they have the recognition from Nintendo fans, and turn it into a moderately successful indie game on Steam.

because free advertising isn't worth crap to nintendo when it comes to zelda, a series everyone knows.

not to mention, its required to keep your copyrights uncontested. just because no one had the audacity to claim, say, metroid for themselves yet, doesn't mean its not something a company such as nintendo wouldnt want to prevent from the getgo.

and how in the world do you believe that someone who never picked up a zeldagame would somehow end up trying this out?
instead of any of the million zelda roms out there?
