Yes, that would not be allowed, as Bleemcast was a commercially available product.

Emulator vs game - I never had an opportunity to use it myself, as I understood its functionality I would have classified it as neither but instead as a utility, just like the disk for an Action Replay for example. However, Wikipedia does refer to it as an emulator multiple times so I'd be inclined to lean that way. https://en.wikipedia.org/wiki/Bleem!

I personally wouldn’t post it with a game, just the emulators. And a readme that says what you need to use it, as mgs and such can be easily acquired on the internet.
The emulator was a commercial product and technology is still copyrighted. If someone reverse-engineered it and made it open-source, then it should be good to post

why would archive.org have the right to host it, and not us, though? what makes them any different?
legit question, have they been designated by governments as the only place where that sort of thing can be archived?

That, I don't know. I just like having anything sacred backed up onto their site, especially when it comes to video game preservation.
