WE NEED FLIPNOTE STUDIO, DSI BROWSER AND DSIWARE
DOWNLOADABLE AgAiN!!!

THAT ARE SOME ESSENTIALS APPS THAT EVERY (NOT HACKED) DSI MUST HAVE!!!!

i mean not hacked because it should stay in the main system

There is no need to shout with all CAPITAL LETTERS and a huge font size.

I hope you realize that even previously free DSiWare like Flipnote Studio are copyrighted material and only the rights holders have the right to distribute them. All the technical problems aside there are huge legal problems. If somebody would announce: "Hey, I've made an alternative server providing all the commercial DSiWare titles via the shop app." it would take some minutes for the Nintendo legal department to send them a realy nice message politely asking them to stop that.

That said: I do see serious problems (preservation) with non-physical distribution in conjunction with the looooooong time period copyright lasts – if the official distribution stops… that's it. Leaves only illegal methods – which can't exist that obvious as a "pirate DSi Shop server" would be.
  • Illegal methods already exist. It is not hard to find DSiWare ROMs.
  • Most DSiWare (okay not Flipnote and not the useless browser) can still be legally obtained with a 2|3DS and copied to a DSi.
    • The presence of the legal offering makes the illegal methods even less justifiable. Even though missing official offerings does not make illegal downloads legal, it is (in my opinion) morally a little different. If there simply is no way to pay (WiiWare) this only leaves "piracy" or not having any kind of preservation.
