Or pretty much every update really until proper prior measures have been taken to ensure that some unwanted consequences will not affect you. Frankly speaking, those who are smart enough probably would have done this already. It's those who never read/learn from past mistakes/use their brain/are unlucky that fall for it LOL XD

Every update is "when not to"
There's really no point to it. You get blocked out of the e-shop, that's about all I see. Which doesn't mean much. You miss some demos and that's about it really.

If you intend to use flashcarts, "never" or "after they are updated to the firmware in question" - it's simple as that.

Nintendo is known to release bs updates like the one you mentioned, yes.

Seeing that the 3DS is not "hacked" yet, it's best to remain on the lowest possible firmware - the later the firmware the bigger the chance that certain exploits are patched. The 3DS already got all the "features" it lacked at launch, at this point, there's no need to update unless you have no intention whatsoever to hack it in the future.

Update only when you're forced to - aka, when a game requires an update to boot.
 
If it ever happens, I somewhat doubt that it'll only work on launch firmware, seeing as how I don't believe anyone has really been working on it. Having said that, it is probably best to keep the lowest firmware you can get away with.

If you mean Crown3DS, you might just as well forget about them and direct your attention to 3DBrew instead. People *are* working on it and they *are* interested in hacking the system, it just takes time.
I hadn't heard of 3DBrew before, I'll check it out. By the way, I mentioned 72% and that "I don't believe anyone has really been working on it" as a way of implying that I don't believe Crown3DS has been working on it.

"When NOT to update your Nintendo 3DS" is when the console either gets a 3DS mode flashcart or softmod.

There are some awesome eShop titles dude. I mean like the actual original exclusives.

Depends. If you have no intention of using flashcarts/homebrew, there's no need to avoid it and lose eShop use, even if you don't have much use for it.

And it depends on what you think of the eShop. There are quite a few great download titles on the eShop that I really like, even excluding virtual console and 3D classics. Games like Mutant Mudds, Sakura Samurai, Mighty Switch Force, and especially Fractured Soul are freaking amazing.

Unless an upgrade has some kick ass content like the implementation of MiiVerse or something similar, I'll not update (unless the game forces me to, then I have no choice).
