ROM Hack Update to latest 11.8?

I have luma 9.1 and 11.7. it is safe to update the system. Will I get ban?

As long as you have spotpass off, hide titles from friends, and don't do anything stupid then you shouldn't get banned

There is always (a very low) ban risk if you hack your 3DS. It has nothing to do with 11.8
Just update and use the Eshop.
