    Yes my O3DS was using a swapped lcfs and got the ban, I don't understand what was the criteria for this ban, a lot of people speculating it was the spotpass setting but that doesn't make sense because both kinds of peope got banned those who had it on and those who didn't some weird shit this.

    I agree, they can do what they want with their private service. I've spoken on the ToS and how it is what it is. I'm just tired of people citing ToS as law when it's not even close.

    unless the banwave is still rolling on I don't think it has anything to do with the region of the games you're playing. I have pirated games from different regions and physical carts from different regions too. and I'm still not banned.

    So i have two EUR o3ds (1 XL, 1 standard) with Luma, A9lh, on 11.4. Both are fine so far. I never used freeshop, but used CIAngel a few times. Not big into piracy.

    To any one seriously arguing what a terrible company nintendo is and that they have no right to ban people (they do):
    You must be kidding. If you pirate or use homebrew you are breaking their ToS. And especially if you pirate you have no reason to claim moral superiority over nintendo for getting banned by them. I'm not condemning piracy but for fucks sake get a grip. You knew what you were doing and you knew it could get you banned being angry about getting banned or claiming nintendo is not consumer friendly for banning people exploiting how their eshop functions to pirate games,is beyond retarded. Just wait for a fix like a reasonable person and don't be a crybaby.

    dude you're 14 and have no idea what you're talking about. Nintendo can ban you from online for any reason at all. they can also discontinue it at any time as well.

    your 'rights' to play on their severs are already limited. don't be so butthurt.

    While I have seen no end of one sided and overreaching contracts I am not seeing any scope for someone to argue against a "our nice luxury service/network, use a device within our parameters or we may revoke access". Functionally it seems similar to "track day for unmodified aston martins", I turn up with one I crowbarred a big old American V8 into and then complaining I can not join in.
