We aren't sharing any copyrighted code and Nintendo does know about this website.
GBAtemp has been at E3 several times and even managed to get an interview with someone from Nintendo.

Nintendo isn't dumb, Nintendo isn't dumb at all.

It's just the fact that this site isn't doing anything wrong like sharing copyrighted code and homebrew is made with open source tools.
Some users condone in piracy, some don't.
A few users advocate piracy and a few are heavily opposed to it but in the end, this community is all about gaming, be it on unmodified consoles or on tricked out modified ones.
