Well its been a day. I sent him another message stating clearly my intentions, I'll give it another 2 days for response. if nothing, negative feed back and i'll buy the part on my own and fix it.

i asked for $30 off, making the total purchase about $95-ish after the part. lets see how it goes

Most sellers on ebay understand a partial refund will cost way less in the long run than a negative feedback(which is currently deserved).
You might not get the full 30 dollars you ask but the seller can't hope you have the skills or expertise to fix this yourself. $15-$30 is a fair refund(since you can repair it yourself).
If you had included partial refund in the poll question, I would have voted that way. Good Luck.

The seller made a mistake, and sold you a defective item, But its you who is the one in the wrong in my opinion, You clearly bought the 3ds knowing it had a low firmware so the chances are it hadnt been connected to wifi so the seller probably didnt even relise that the fault existed.
If it bothered you, you should of returned it for a refund, NIntendo wouldnt accepted a return of the 3ds once you opened it, so a ebay seller shouldnt accept a return either.
I think that you should count yourself lucky that it was a simple wifi card swap, and not someting more serious.
rate the seller with positive feedback and thank him for the fast postage,

regardless if he realized its broken, its his mistake and yes, he is responsible as the seller. that is the risk you take when you sell something, i always feel anxious when i sell something because i'm afraid i made an oversight and something wasn't working as planned. if that did occur, its completely my fault.

i understand opening the console is unethical, but its just 7 screws AND it was clearly opened before I got it, I could tell by the tightness of the screws. i have plenty of experience opening things and fixing them. there is no risk in my opinion that is why i did it (plus again i could tell it had been opened before).

you should of given the seller chance to reticfy the mistake before opening it up, and since you didnt you are now liable for the cost of repair.
You cannot be sure that the seller of the item was the person that opened the 3ds up, and if it was he probably would of bought a wifi card for a couple of dollars to fix it if he was aware of the fault.

i do want money off - ive said that multiple times now. i am not whining about it, its broken and i can fix it, i should get a discount for the issue.

2nd - the seller cannot tell i have opened it. again i know its unethical but i also am 100% sure i didnt damage anything.

I fully support you in your actions and I'd have done the same myself.
From your info, it's evident that he knew the problem, opened it and didn't work out how to fix himself.
Sounds like he went quiet when he realised he hasn't gotten away with it.

I find that's what a seller does when they don't want to issue a refund.

I'd repair and just give him negative feedback. They give the seller a chance to "fix the issue" so perhaps you could have him recoupe some of the cost you need to put into purchasing a new wifi chip + shipping. Maybe get 10-20 of your dollars back from the purchase?

He confirmed the case had been opened before. Seller had to of known of the issue, and lack of any response shows he KNEW of it. If he didn't surely he would have defended the product. The seller doesn't deserve positive feedback if he was contacted about an issue and left no response. This is how the world works. Negative feedback.

And also, depending on how the product was packaged its VERY unlikely that an internal component like the wifi card could become damaged through the shipping process.

Like Maximilious said above. Also, for someone with my skill level for repair there is a 0% chance that I damaged it when I opened it.

To anyone that posted in this thread that doubts my actions were at least courteous, please allow me to sell you this "working" 3DS XL, there aren't any problems with it at all. then when you get it and verify there is a problem - you have no right to come and ask me anything AND I deserve positive feed back.

The unit has been opened, that doesnt mean the seller is aware its broken, they may have bought it s/h and never used wifi. I bought a DS off a friend years ago and the mic didnt work, he was totally unaware since none of the few games he's played use the mic.

And 3 days is NOT long enough to jump on the negative feedback button, the seller may have a life and not sit over his email inbox, there are endless reasons for not replying within 3 days. I am sure the ebay recomended time is 5 working days.

I took a few screws out, I removed some plastic - this does not damage the wifi board. I also verified that my other wifi board works fine in it! This only verifies the product is defective to start with.

3 days is enough if you sell on ebay, as someone who buys/sells things all the time its important to ensure you stay in touch with the people who buy from you. Especially right after it has sold and marked delivered. If you sell on ebay (this guy has MANY items listed, its a store) you visit more than 1 time in 3 days. Its probably more like 1 time per every 4 hours to be more realistic.

I believe you can not leave a negative feedback for at least the first 7 days on ebay. The negative feedback should get his attention. Hopefully, you guys can still come to a satisfactory solution for both of you. The negative feedback for poor communication alone is justified.

Funny enough they replied today, with the lame excuse "we were closed yesterday" (what about Friday and Saturday!?!?) and are offering the $30. I'm satisfied from here if they refund it.

VashTS - Just ignore anyone else that has issues with your actions. Any logical person can see you did the right thing, and it seems the seller will be sending you your repair costs back which is a plus. Good job!
