Sooo... with a patched Sudokuhax does that mean Data transfer from DS => 3DS will make you update it?

Only time will tell.

From the info we have so far, the DSi just sends the 3DS a list of the DSiWare installed, which is then used in a download script. So no actual DSiWare transfer happens through the transfer.

If only they made a way to downgrade the game to use Sudokuhax. That'd be awesome.
