Homebrew Safe to use Streetpass while on a 3DS with CFW?

I have been looking around a lot and I've found fairly mixed answers on what I would guess would be outdated forums as they date back to early 2017 and early 2018. However, I would like to be updated on whether or not it is safe to use streetpass and only streetpass, no spotpass, on a 3ds with CFW.

I've mainly heard that it is 100% local data transfers, but I've seen here and there that it also sends data to Tendy.

Is this true that its entirely local only or not?

I have streetpass disabled as of right now and I will not re-enable(Had it on when I was on stock fw) it until I have a surefire answer.

It's 100% safe to use Streetpass with a hacked 3DS. I have used a streetpass on my hacked 3DS for 3 years now and I haven't had an issue.
Streetpass is only local and nothing is sent back to Nintendo.

Streetpass is just local, I've never had any problems with it.

I thought streetpass was abandoned by nintendo a long time ago.
But hell, who even still bothers to use it and how often do you actually get any hits with it?

I know I'm late to the party, sorry... Personally I find Streetpass gets hits way more often then I'd expect. Especially if I'm traveling around town with it. I do live in a nice size city but it's not that big, only about 200-300k population, and its very spread out.... So, yeah it's definitely worth using, IMO, if there's no harm in it.

i use spot pass also and i did not get banned. (i only use it for zelda tri-force heroes)
