Not sure if you've tried, but if you're on O3DS 10.3.0-28U, the eShop opens up no problem. I'm able to do this through both Ironhax and Oothax. Just to be sure, I used smea's eShop spoof to download Pokemon Picross, and it worked just fine.

Since the eShop changes the BGM every now and again, will this application make it so the same song is played every time whilst in the eShop, whether we choose one or not?

10.2 users and up should have no problem accessing the eShop given their NVer is 28 (which, since you're talking about 10.2, it should be). Though if you're on 10.2 you'll need to use HANS, obviously.

If you have OoT, I suggest you install Oothax and update.

Another workaround is being worked on to get eShop access for those of us whose NVer is <28, however the amount of progress made thus far is unclear. But it's being worked on; that much we know.
