Hacking R4infinity and standby in 3DS

Hi, My problem is that the flashcard doesn't stop the game whenever I close my console, and the sound keeps playing but cracking (I think that's the word) and thus my 3DS burns through the batery in no time, like if it wasn't in sleep mode.

If it is important to know, I downgraded the DS firm from my 3DS via .cia files and patched the whitelist so this card would work.

the card that I'm using is the oldest from r4infinity.com and yes, it is a clone, but I don't remember having this issue when it was new, maybe an update did this?
