If I were to buy a new switch, should I go for one on ebay, or new from the store?

It is up to you, or you can buy tablet only for less than $200, so you can use existing joy-con with it.

As for homebrew on Atmos, I use Checkpoint to backup and inject the saves, including edited one, so ban risk is pretty low, but risk goes high if run CFW online.

But wasn't there a report of someone who cleared the logs getting banned?

No i dont See any Report about this

If you went online with error codes previously, so clear the logs are risky, but if you never had error codes when go online before, so clear the logs may be safe.

If I were to buy a new switch, I could export my old saves via checkpoint and import them on the new one? And by cfw online, I tend to turn off the wifi when it's not critical on the switch.

- Bad scenario
If you're using SX with strange error logs and connect online you'd be banned already.

Keep in mind that the main reason to have emunand is to keep sysnand on low firmware or to go online on pure sysnand.

If you're on the second half of the reason and your nand is full of strange error logs/ never connect online before, you'd have to delete ticketblob and error logs using hacdiskmount to mount SYSTEM

Delete these files
Error logs
SYSTEM/save/80000000000000D1
Common/Personlized ticketblob
SYSTEM/save/80000000000000e1
SYSTEM/save/80000000000000e2

Do factory restore settings offline.

You now have pure sysnand.
Ninty cannot ban for Clearing Logs offline via factorysettings

Actually, I just remembered something, a lot of the errors are 2137-8035 in system settings on the day i updated to 6.1, when it failed to install due to dns blocking.

After an hour long phone call with Nintendo my ban was the result of a clear log after receiving logs on my previous connection with the eshop so clearly your wrong on it not being risky .
That cannot be the reason since when You Make a Factory reset offline You lose the Logs too and that cannot be a reason for ban

Yes, you can but you have to find unpatched Switch that can be hard in some area.

Oh I see, not gonna to sell hacked one.
But back on topic, what are the red flags?

And if I took the risk and got banned, what happens in regards to my nintendo account? Would I be able to use it on a different switch if I bought a new one after the fact?

Nintendo uses formula with multiple error codes to see factor if you used CFW, so yes, it is possibly flagged.

Your Nintendo account is safe but not Switch, so you can unlink via Nintendo website and relink in new Switch. The account ban is rare.

Hmm, so I might as well go ahead and get a new switch...
