Try your luck, worst that can happen is receiving a project bill to authorize the repair service and you may refuse to pay it and receive you console as it is, I think (that's normally how it works in Brazil anyway).

If they refuse to repair it under warranty, they're technically breaking the law. It should be fine, he's never had CFW on it after all so they have no reason to refuse it.

I have another N3DS and it has a fully working emunand so would I be able to use that on this 3ds?
