Nintendo has taken down the Link's Awakening fan remake

Unsurprisingly, Nintendo of America has gone after the Link's Awakening DX HD fan project, less than a day after the fangame gained publicity online. Once hosted on Itch.io, The Legend of Zelda: Link's Awakening DX HD has been removed from the platform, following a DMCA takedown from Nintendo. The notice, shown below, cites copyright infringement for uploading a fully playable version of a Nintendo game. The Link's Awakening fangame was uploaded only after it was completed, though, meaning a backup likely still lurks somewhere on the internet.

To Whom It May Concern:

I am an authorized representative of Nintendo of America Inc., owner of the following copyrighted material:

PA0002212311 (The Legend of Zelda: Link’s Awakening) and PA0000772666 (Legend of Zelda : Link's awakening (Game Boy version).

It has come to our attention that the following game, https://linksawakeningdxhd.itch.io/links-awakening-dx-hd, offered on Itch.io infringes and makes unauthorized use of Nintendo’s copyrights in The Legend of Zelda: Link’s Awakening video game.

For additional information visit Nintendo’s website at the following URLs:

I miss the old times, when video games were supposed to be about having fun, and not a 100% pure business thing
What magical time was this? Intellectual property laws have been around and affecting entertainment from before video games existence. Copy protection schemes have existed from the start of the video game industry and there was a patent infringement lawsuit around Pong and Magnavox which is generally considered to be the first home video game.

I must say I was hoping for a '1.1' release before Nintendo took it down. It's nice but there could be some improvements. For some reasons controller support was a bit buggy for me. It would have also been nice if we could map the scaling to buttons on the controller, it's SUPER cool to see the whole world 'alive' and moving, but I'd love for an easy way to zoom in when I go inside

To Nintendo it was never about the fun and always about the business. That's how they roll, may Iwata be turning on his grave.
I mean, that was kinda my point. Back in Satoru Iwata sensei time, yes, it was still a business thing, but at least, we could see there was a "it's all about fun" thing.
We could see Iwata, Miyamoto and many other big figure of Nintendo during Direct, which happened more often back then than now.
If you want my opinion, Nintendo is becoming a lot like mcdonald

You kind of have to question the sanity of anyone that undertakes projects like these, knowing that this is always the inevitable outcome when dealing with Nintendo IP's.
Well if you're working on a project knowing you're not gonna make any money off it in the first place, then a DMCA takedown was never gonna deter you.

Yeah... like if you design and build an elaborate extension for your house without acquiring planning permission, permits, etc, and know that it will get demolished as soon as the authorities find out about it... totally sane.

Seriously, if the dev cared about reaching an audience they would've changed enough of it to not encroach on any intelectual property... but riding on the coat tails of a revered franchise was obviously more important.

IIRC Nintendo sued (and lost) to prevent sales of the Game Genie back on the NES, game rentals and are at least attributed with the 30% fee devs/publishers deal as well as other restrictions.

Simple: Dont support Nintendo for next console system and games in the future. Let them bankrupted then. That's why I sold Nintendo Switch 1 Generation system. Nintendo is done! They are cruel company! Hello Sony and Microsoft!

You may want to refocus your efforts on the EU version then. Or, are you trying to make a better US version? In which case, the only way to make a better US version is to keep on plugging away at that one ;)

I would like to eventually have the ability to add more characters, enemies, even have a completely different story if i wanted. I already have the ability to change the tilemaps in the US version, so I can basically make my own map and warp to it in game - so I'm pretty far into it!
