Yeah i was thinking it could be the Freeshop but that doesn't make any sence, because there's people like me who have recently used the Freeshop and haven't got a ban. Question is:

Never used Freeshop. The last week was the usual, FTPD, NTR CFW, e-shop visit, InputRedirectionNTR, FBI, JKSV, really nothing that I haven't done for the better part of a year.

11.4 I guess, CFW too, it's really broad now. Pokemon players, an MK7 player, Fire Emblem players, someone who doesn't play either, much less go online.

Well at least im not banned. Just connected to Sm4sh and everything works fine.
EDIT: Gonna try to ask in one of the Spanish FB groups. Some say they were just playing normally and then went online and got the ban.

ok I have been banned, trying update my Braverly default village. I'm on the lattest arm9loader + luma
Didn't even cheat playing legit so yeah it's a ban wave
