I had that off and I had the settings in friends list off
I see....I got one more question.Did you have incognito mode enabled? You need to have it on so you can keep your activity log clear since Nintendo can also check that.Otherwise you will have a page full of homebrew apps recorded.

They dont pull your activity log. You can clear it if ya want, but it has been said that nintendo doesnt pull that "yet" and I doubt they will since they can see what you play while you are online. Thats why I got rid of all homebrew.

Then that only leaves one reason for the ban,Nintendo had enough intel on your 3ds before you switched spot pass off and incognito mode on.Since this isn't a wave,they individually chose to ban you for whatever reason they had.

But the point is they can right? We have no other leads on these bans other than knowing Nintendo can see when your running unauthorized software on the system.We just don't know exactly how they can other then the activity log and spotpass.
