No. It is selling real emails.

Just two weeks ago, I saw his auctions reach 200-300 dollars.

FOR A FREE EMAIL.

He picked emails that businesses (or scam artists) could use for their work. People who want to stand by the 3DS hype selling stuff.

Generally not a good idea to buy email addresses on eBay.

Selling email addresses is against the TOS 99% of the time, and there's a good chance for it to be reported/banned after you get it for said TOS violation.

Legal? Absolutely 100% legal. There is no law against transfer of digital goods or services for money.
Against the services TOS? Almost assuredly.
