Gaming is this scam?

Legal? Absolutely 100% legal. There is no law against transfer of digital goods or services for money.
Against the services TOS? Almost assuredly.

No, Gmail actually prohibits selling their email accounts through third party sources, including ebay. It's illegal.

I should report this guy, then...
I already did, Ebay doesn't have a set category though, so I'll probably email Gmail of this as well.

It's technically legal.

EDIT: Well, I don't know actually, since I'm pretty sure the account would be owned to Google. But it's like how people sell MMO accounts. I don't think it's illegal.

If you think about it like domain names for websites, there's not much of a problem. Like if Microsoft owned Microsoft.com but didn't own Microsoft.net and some dude bought it, I'm sure it'd sell rather high for the name itself. Big opportunity for advertisement.

Please READ MY POST before you call me wrong.

Also, Gmail is NOT the Government. They do not make laws, therefore it is NOT ILLEGAL.

That's "Domain Squatting" or "Cyber Squatting" and prohibited by the ICANN.

If it's against both Gmail's and Ebay's (The only two websites involved) TOS, guess what? IT'S ILLEGAL!!!!!

Still, illegal or not, it's against the TOS for both websites, it should be reported.

Like he said, it's legal to sell a domain. Even an account.

A "popular" example would be David Turnbull's YouTube channel (/Nintendo3DS). Nintendo contacted him and offered an early 3DS and other stuff if he gave them the account name.

Considering Nintendo has a trademark on that name (both Nintendo and Nintendo 3DS), they were trying to be nice, and not get negative publicity by sueing them.

EBAY IS NOT THE GOVERNMENT.
EBAY DOES NOT MAKE LAWS.
EBAY CANNOT MAKE SOMETHING ILLEGAL.

GMAIL IS NOT THE GOVERNMENT.
GMAIL DOES NOT MAKE LAWS.
GMAIL CANNOT MAKE SOMETHING ILLEGAL.

Take a Junior High US Law class and then come back.

Fine, you're right, but like I said, "illegal or not", it violates both TOS's, and should be reported.

I think some people think it's the 3DS itself, they just look at the picture and the top part of the description. Still, that doesn't explain why none of the other email addresses like this aren't even remotely that high.
