What's the difference between downloading an illegal copy of a game and running it on the r4 and an emulator like this forum suggusts? im confused. And while we're at it, what's a memory .sav file? how aren't those illegal? or are thay?
so if i own a copy for super mario 64 ds and i download it on to an r4 its not illegal? cool. now a .sav is also not illegal even if i dont own a hard copy?
here is the page. Its only illegal if you don't have the game, running the game on your R4 is a BACKUP, you downloaded the game, and ran it because.... perhaps you didn't want to ruin your original.
Ìt's illegal either way if you own the actual game or if you don't both ways, having roms on your computer is illegal.
nintendo legalCan I Download a Nintendo ROM from the Internet if I Already Own the Authentic Game?
There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a Nintendo ROM from the Internet.
But...running roms on either have the same legal backing. If you own the game and it's your copy...good. If you're running something that you didn't pay for, it's illegal.
They say it does, which is why it auto boots unlike most carts.
It's debatable. I belive US law would consider it illegal.so if i own a copy for super mario 64 ds and i download it on to an r4 its not illegal? cool. now a .sav is also not illegal even if i dont own a hard copy?
If you download it, it is still illegal. Unless you rip it yourself, it's illegal. And a save file isn't the actual game. You seem to be very misinformed.
The DS ROMs are illegal no matter what.
Don't own the game? Illegal.
Own the game and downloaded it? Illegal.
Own the game and made the backup yourself? Illegal.
Carts are not covered under the decaying media law that allows us to make a backup for our disc based media.

For those who don't know know the law he's referring to is the DMCA. Digital Millennium Copyrights Act.
