What's the difference between downloading an illegal copy of a game and running it on the r4 and an emulator like this forum suggusts? im confused. And while we're at it, what's a memory .sav file? how aren't those illegal? or are thay?

Running it on an R4 is just as illegal as running the game on an emulator.

.sav files are not illegal because it is only data that pertains to the completion of the game and have no value unless you obtain said game legally or illegally.

The R4 and the emulator both in themselves are NOT illegal (unless either was built using company information ie: stolen sys docs from warioworld.com)

But...running roms on either have the same legal backing. If you own the game and it's your copy...good. If you're running something that you didn't pay for, it's illegal.

Its only illegal if you don't have the game, running the game on your R4 is a BACKUP, you downloaded the game, and ran it because.... perhaps you didn't want to ruin your original.

If you download it, it is still illegal. Unless you rip it yourself, it's illegal. And a save file isn't the actual game. You seem to be very misinformed.

Ìt's illegal either way if you own the actual game or if you don't both ways, having roms on your computer is illegal.

nintendo legalCan I Download a Nintendo ROM from the Internet if I Already Own the Authentic Game?

There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a Nintendo ROM from the Internet.
here is the page.

While I can't quote any specific laws, I'm pretty sure it's all illegal. When you buy a game, you buy one copy, and making/obtaining/using another is illegal.

Doesn't stop me though!

It says somewhere (maybe in the user booklet in games boxes) that storing backups or copying the game in any way is illegal and applies to the whole world probably.

The DS ROMs are illegal no matter what.

Don't own the game? Illegal.
Own the game and downloaded it? Illegal.
Own the game and made the backup yourself? Illegal.

Carts are not covered under the decaying media law that allows us to make a backup for our disc based media.

For those who don't know know the law he's referring to is the DMCA. Digital Millennium Copyrights Act.

Thank you, I couldn't think what it was called.

No problem; Anyway, the DMCA does not cover currently produced media as an exemption to the law. As far as I know (this act has been altered many times in the past few years; since the RIAA started publicly ousting people), only discontinued media (excluding music; unless the user decides to convert the format for an MP3 player AND does not distribute the backup) can be reproduced as a backup if user owns the original copy, does not distribute the file AND destroys the backup once user loses ownership of the original.

EDIT: Also note that just because the product becomes discontinued does not mean that you can back up ROMs due to "other" copyright laws. Basically, it's forever illegal.

EDIT2: Other copyright laws such as: Trademark laws, Royalties and Technology Patents.

Or when your player dies, you can say in code, if enemy exists, do nothing, but if enemy does not exist, then create enemy at certain spot. (This would be a pain tho for lots of emeies)
