Homebrew If I don't have a DLC Theme, am I screwed?

So I am using a 3DS XL with ninjhax working and running. I have successfully gotten custom themes to load on my XL, but every time I load a game or close the screen it puts it back to default.

I read that the solution is to download a DLC theme. Problem is, I cannot update or else it breaks the homebrew. Any solution?
