Gaming HBC installed - Can I run the Nintendo Channel?

I have the Homebrew Channel installed. Can I run the Nintendo Channel, considering the fact it sends all your gameplay to Nintendo?

Some people say no, some say yes.

Can I or no?

Before I had the HBC I remember seeing the playtime. It would say

Animal Crossing: City Folk 214 Hours

Mario Kart Wii 150 Hours

Other Games...

Nintendo knows what your doing. They can find out your using the HBC and brick you?

    Yeah idk for the little over 2 years I've been playing so far at least, I don't feel like the meta has changed much at all in Commander. I've been playing the same 2 decks, both virtually unchanged, for the past year and a half, and there's been no real change in their performance over time against others that have been building new decks with each new set
