I have the Homebrew Channel installed. Can I run the Nintendo Channel, considering the fact it sends all your gameplay to Nintendo?

Some people say no, some say yes.

    Can I or no?

Won't Nintendo see that I'm using the HBC?

Before I had the HBC I remember seeing the playtime. It would say

Animal Crossing: City Folk 214 Hours

    Mario Kart Wii 150 Hours

    Other Games...

Nintendo knows what your doing. They can find out your using the HBC and brick you?

legally, they can't force you to update and thus brick your wii
