No they're linked together currently. I tried a retail cartridge in classic mode and the same error code came up.
Well, in worst case scenario is a perma-ban. Best case scenario, it's nothing and people are freaking out for nothing.

Not sure about anything at this point, but I'm sure you are certain that's not your router/ISP unable to connect to Nintendo Servers, yes? I mean, my ISP does that every time, I can't connect to websites of a certain region and such.

I havn't blocked the servers in the router, nothings changed to be honest on my side. But I can connect to the miiverse and eshop servers, so I don't think thats the issue. Will find out soon enough and let everybody know what they say, hopefully no more issues pop up for anybody else though.

Is the ban on the system or the account? If the latter, couldn't you just open a new account?

That is what we are waiting on. Some users lost access however later they were fine; others are having no luck and people like me are not affected at all.

Just played Animal Crossing online and Mario Kart 7. Both using the same MGS3 public header and everything was fine.
I'm on emuNAND 9.4, sysNAND 4.4, US console, both games US region too.

How did you play online when 9.5 is out if you are on 9.4? It makes you update.

No. You don't need to be up-to-date with the firmware version to play online.

As long as your games are up-to-date, it's okay.

Tried to connect twice with a game online and worked fine here (I use MGS3 header but from my own cart, not the public one).

Nope. You don't need to have the latest firmware in order to play online. You only need the game updated.
My buddy couldn't play online with an older firmware just last night. It gave him an error code which basically told him to update the console.

I don't know what he was talking about then he said he couldn't get online with a 9.2 console.

I don't know what he did. I'm just telling you a fact. You only need to have the latest firmware in order to access eShop.

To play online you need: a)a rom compatible with online or cia; b) you need to have the game updated (when there's any); c) internet connection; d) firmware at least the same as the required for the game (unless you spoof it)

eh...I would only use the eShop for updates or Cub Nintendo redemptions...once my gateway comes

I'll never would play a .CIA or downloaded 3DS game online....am I safe?
so....this only is for users who play downloaded 3DS games online right....?? I saw that you have to modify some headers to get downloaded games to play online

Nothing is confirmed at this point. No one knows, except maybe Nintendo :P

My gateway arrives any day now...I just want to EMUNAND and redeem my Club Nintendo coins and Grab Flipnote Studio 3D and be on my merry way and not go online....for CIA or ROMS

In order to make a new NNID on a 3DS, you have to format to remove the old one, right? Here's the kicker: in order to format, you have to connect to the internet to verify your NNID status. If it's banned, you cannot format the system. This happened to a guy at Gamefaqs who bought a used 3DS and it had a banned NNID on it, and he couldn't put a new NNID on it.
