As the title states, If I was to get banned by using hacks or CFW, would I still be able to play games like smash with my friends local?

Splatoon 2 = no split screen. If it doesn't work hopefully in the future we will be able to patch it but both console will have to have cfw

Yes, You can.

With a banned console, you can upgrade your firmware, and update your game.

You CANNOT use eShop, and CANNOT play ONLINE. Local playing is not affected.

Do we know if eShop games and DLC that have already been downloaded to a now banned console will still work?

Nintendo has never locked down or disabled functionality in banned consoles. It did only that: banned them from their online services.

We dont even know if they will issue Eshop bans to every user who gets banned. Like on 3DS, they only banned online play. But Pokemon Sun/Moon leakers got an Eshop ban. Its a different case depending on what the ban reasoning is. That's what I think at least. We'll have to see.

Just found out he's doing alright, doing a lot of complaining too, rightfully so. Who wouldn't complain after having a seizure and being hospitalized?
