Hacking Discussion Banned switch on 6.01 but account not banned

When I was on call with a Nintendo supervisor of Nintendo of America, I was told my switch console was placed on permanent hold, but my account was not, and that buying a new switch would allow me to access my account and continue to play games, which I found was weird, I also found that I was banned by Nintendo of Japan, and that to receive further information I would have to call them since they would have a full report on my ban, but the supervisor said they only provide support to Japanese users, and that they do not provide a translation service. I was warned however that my account may be banned in the future even if it is not currently banned and if I don't use any modifications on my new console, but he said it was a very small likely hood of that happening.

Should I take the risk and use my account on my new switch since I spent around $450 on games on my main account?

Also, why does Nintendo of Japan issue certain bans while Nintendo of America sometimes does this? Why not place the ban based on the user's region and why have it segmented in such a way?

(Error code 2124-4007, and 2181-4008)

Also I am still able to receive updates, and when modding I only used Hekate, and only ran emulators (no game modifications, backups, or pirating)

Second, Nintendo rarely bans the account and there's really no reason to since accounts are free. They traditionally ban the console because that one costs $300 to replace.

Thirdly, there is a risk for using an account from a hacked console on a non-hacked Switch but I don't think Nintendo would ban a console that isn't hacked even if the account associated with it came from a modded unit.

This is something that I don't like. I've accepted my ban with grace and bought a new console. Haven't attempted any modifications on it and I don't plan to. A ban because I'm using my account (too many purchases to start over) on this new Switch would just be the straw to break the camels back. I'm continuing to make purchases and even paying for their online service. To have that taken away because of a past transgression that hasn't carried over would be very anti-consumer.

I am worried as my modded BotW save carried over. :o

As a multi Switch owner of which one superbanned (eshop and cdn ban) and one squeeky clean I can say I have been using the same account without issues. I made sure I made the new Switch the primary console for the account. The superbanned one can not go online for Nintendo services but all my purchases are tied to the account.

And as far as I can tell those account bans are very very rare.
